OVERVIEW

Welcome to MaddyParts! The terms "we", "us" and "our" refer to MaddyParts, a trading name of Lucas Huls Media. MaddyParts operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). MaddyParts is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights, including your right of withdrawal as a consumer within the European Union, warranty information, and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

These Terms do not affect your statutory rights as a consumer under the law of your country of residence, including the Dutch Civil Code (Burgerlijk Wetboek) and applicable EU consumer protection law.

By agreeing to these Terms of Service, you represent that you are at least 18 years old, or that you have the consent of a parent or legal guardian to use the Services.

To use the Services, including purchasing any of the products we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS

We make every reasonable effort to provide an accurate representation of our products in our online store. However, colors or product appearance may differ slightly from how they appear on your screen due to your device and display settings.

Product descriptions are subject to change at any time. We reserve the right to discontinue any product at any time and to limit quantities offered to any person or region.

Vehicle compatibility: Many of our products are designed for specific vehicle makes, models, and production years. It is your responsibility to verify that the product you order is compatible with your specific vehicle before placing an order, using the compatibility information provided on the product page. MaddyParts is not liable for orders placed for incompatible vehicles due to customer error.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase, which we may accept or decline at our discretion. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order has been forwarded to our supplier for fulfilment.

If we are unable to accept, must change, or must cancel an order, we will notify you using the email address or contact details you provided.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale, unless otherwise agreed with us in writing.

SECTION 4 - PRICES AND BILLING

All prices are listed in EUR and include applicable VAT unless stated otherwise. Shipping costs are shown separately at checkout before you complete your order.

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as confirmed in your order confirmation email.

You agree to provide current, complete, and accurate payment information for all purchases, and you represent that you are duly authorized to use the payment method provided.

SECTION 5 - RIGHT OF WITHDRAWAL (EU CONSUMERS)

If you are a consumer residing in the European Union, you have the right to withdraw from your purchase within 14 calendar days of receiving your product, without giving any reason.

To exercise this right, you must inform us of your decision to withdraw by a clear statement (e.g. an email to maddyparts@lucashulsmedia.nl) before the withdrawal period expires.

Return shipping: Unless a product is defective or not as described, return shipping costs are your responsibility. We recommend using a trackable shipping method, as we cannot be held responsible for items lost in transit back to us.

Refunds: Once we receive and inspect your returned item, we will process your refund to your original payment method within 14 days. We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent them back, whichever is earliest.

Exceptions: The right of withdrawal does not apply to products that have been installed, modified, or are no longer in their original condition, except where this was necessary to establish the nature or functioning of the product.

This section is in addition to, and does not limit, your statutory rights under Dutch and EU consumer protection law.

SECTION 6 - STATUTORY WARRANTY (CONFORMITY)

As a consumer within the EU, you are entitled to a statutory warranty of conformity, meaning that products must match their description and be fit for their intended purpose at the time of delivery. If a product is defective or does not conform to its description, you may be entitled to a repair, replacement, price reduction, or refund in accordance with applicable Dutch and EU consumer law.

Nothing in these Terms is intended to limit or exclude your statutory warranty rights as a consumer.

SECTION 7 - SHIPPING AND DELIVERY

Estimated delivery times are provided on each product page and at checkout. As many of our products are shipped directly from our suppliers, delivery times may vary and are estimates only, not guarantees.

We are not responsible for delays caused by the shipping carrier, customs processing, or other circumstances outside our reasonable control. If a shipment is significantly delayed, please contact us so we can investigate with our supplier.

For shipments outside the EU, you may be responsible for import duties or customs fees imposed by your local authorities. These are not included in our prices and are your responsibility.

SECTION 8 - INTELLECTUAL PROPERTY

Our Services, including but not limited to trademarks, text, images, graphics, product descriptions, and the design and arrangement thereof, are owned by MaddyParts, its affiliates, or licensors, and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, publicly display, or otherwise exploit any material from the Services without our prior written consent.

MaddyParts's name, logo, and product names are trademarks of MaddyParts. Shopify's name, logo, and related marks are trademarks of Shopify. All other trademarks are the property of their respective owners.

SECTION 9 - OPTIONAL THIRD-PARTY TOOLS

You may be provided with access to tools offered by third parties as part of the Services, which we do not monitor or control. Such tools are provided "as is" and "as available" without any warranties. We have no liability arising from your use of third-party tools, and you should review the relevant third party's own terms before use.

SECTION 10 - THIRD-PARTY LINKS

The Services may contain links to third-party websites. We are not responsible for examining or evaluating the content or accuracy of any third-party site. If you access a third-party site through our Services, you do so at your own risk, and any transaction is solely between you and that third party.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

MaddyParts is powered by Shopify, which enables us to provide the Services to you. Any sales made through our store are made directly with MaddyParts. Shopify is not responsible for any aspect of sales between you and MaddyParts, including any loss or damage resulting from purchased products.

SECTION 12 - PRIVACY POLICY

All personal information we collect is subject to our Privacy Policy, available on our website. Because the Services are hosted by Shopify, Shopify also processes certain personal data on our behalf in order to provide and improve the Services. Please review our Privacy Policy for full details on how your personal data is collected, used, and protected, in accordance with the GDPR (General Data Protection Regulation).

If you submit any ideas, suggestions, reviews, or other feedback ("Feedback"), you grant us a worldwide, royalty-free, perpetual license to use, reproduce, and publish such Feedback for any purpose, including commercial use. You confirm that your Feedback is your own, does not infringe any third party's rights, and does not contain unlawful, abusive, or misleading content. We are under no obligation to use, respond to, or compensate you for any Feedback submitted.

Occasionally, our Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability. We reserve the right to correct such errors and to update or cancel orders affected by inaccurate information, even after an order has been submitted, and will notify you accordingly.

Provisions which by their nature should survive termination (including Intellectual Property, Feedback, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

To the fullest extent permitted by applicable Dutch and EU law, MaddyParts shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services or any product purchased through the Services, including lost profits or lost data, except where such liability cannot be excluded under mandatory consumer protection law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under Dutch or EU law, including your statutory rights as a consumer described in Sections 5 and 6.

SECTION 19 - INDEMNIFICATION

You agree to indemnify and hold harmless MaddyParts, Shopify, and our respective affiliates, officers, and employees from any claims, damages, or liabilities, including reasonable legal fees, arising from your breach of these Terms, your violation of any law or third-party right, or your misuse of the Services.

SECTION 20 - SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

SECTION 21 - ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and MaddyParts regarding your use of the Services, superseding any prior agreements or communications.

SECTION 22 - GOVERNING LAW AND DISPUTES

These Terms of Service are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the Services shall be submitted to the competent court in Overijssel, the Netherlands, without prejudice to your right as a consumer to bring proceedings in the courts of your own country of residence within the EU, where applicable under mandatory consumer protection law.

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to resolve disputes out of court.

SECTION 23 - CHANGES TO TERMS OF SERVICE

We may update these Terms of Service from time to time by posting changes on our website. Material changes will be communicated to you where required by law. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
